Schedule ‘B’

The following Restrictive Covenants shall be registered with title to all lots in the Bridle Path subdivision, it being the intent of the developer that all homes in the subdivision are to reflect these characteristics. 

1.                  All home plans for construction of homes or the construction of any additional building or structure, prior to June 30, 2008, shall be approved by Tim Banks or Brian Gillis, or their designates, as appointed in writing.  It being understood that any such approval shall not be unreasonably withheld.  Thereafter, any new home plans or design changes to existing plans shall be prepared and endorsed to conform to these design Covenants by a professional architect licensed to practice architecture in Prince Edward Island.

2.                   Enforcement of these Covenants shall be the responsibility of Tim Banks or his designate for the period expiring June 30, 2011, and thereafter enforcement shall be the responsibility of the residents of the subdivision.

3.                   The above grade gross floor area of any home shall be a minimum of 2200 square feet inclusive of garage area.

4.                   At least 66% of a home’s roof shall have a minimum of 6/12 pitch.

5.                   Not withstanding the minimum setback requirements established by the City of Charlottetown, the front yard setback for the Bridle Path Subdivision shall be 40 ft.  In addition to the foregoing, no dwelling or structure shall be constructed which shall have any part of the said structure nearer than six (6) feet to another side yard property line.

6.                   No metal siding or metal roofing shall be installed on any home.  Vinyl siding may only be used with the written approval and consent of Tim Banks or his designate, or after June 30, 2010 by the residents of the subdivision.  Approved siding materials are painted or weathered wood shingles, clapboard or paneling, painted cement siding, Norman Rockwell Collection Vinyl siding, “Hardiplank”, stucco or brick.

7.                   No fence shall be installed on any lot extending from the street to the front elevation line of the home situate on the land.

8.                   No gravel driveways or walkways are permitted.  Driveways are to be finished in hard surface (i.e., concrete, paving stone, asphalt).

9.                   All Lands disturbed by construction shall be landscaped within eight (8) months from the completion of the construction of any structure built upon the lands.

10.               NO exterior aerials, antennas or satellite dishes with a diameter greater than two (2) feet may be erected or maintained on the Lot without the prior written consent of Tim Banks, or his designate, who must first consult adjacent lot owners before replying to the request for permission.  Any satellite dish installed shall be placed in a location where it will not interfere with the appearance of the Lot.

11.               The owner of any lot shall not permit the condition of the surface of the land to be or fall to a condition below the standard of landscaping normally found in a first class residential neighborhood.  The owner of any lot shall not permit the surface of any vacant land to be in a condition that would or would be likely to interfere with the enjoyment of adjoining lots.

12.               The lands and any dwelling erected or to be erected thereon shall not be used for the purpose of any profession, trade, employment, service, manufacture or business of any description (including the breeding of pets for sale), nor as a school, hospital or other charitable institution, nor as a hotel, apartment house, bed and breakfast, rooming house or place of public resort, nor for any sport (other than such games as are usually played in connection with the occupants of a private residence), nor for any other purpose than a private residence for the use of one family only to each dwelling, nor shall anything be done or permitted upon any of the lands or buildings erected or to be erected thereon which shall be a nuisance to the occupants of any neighboring lands or buildings.  “In-law suites” shall be permitted to the extent permissible under the Zoning By-Laws of the City of Charlottetown.

13.               No major repairs to any motor vehicle, boat or trailer shall be effected on the lands, except within a wholly enclosed garage.

14.               All boats, motor vehicles, recreational vehicles, trailers or campers with living, sleeping or eating accommodations shall only be placed, located, kept or maintained on the lands beside or behind the dwelling.

15.               No recreation vehicle, ATV, snowmobile, dirt bike or dune buggy shall be operated within the subdivision on vacant land or on parkland.  Such vehicles may only be driven to and from personal residences and the recreational use of such vehicles within the subdivision is strictly prohibited.

16.               No truck over one ton shall be placed, located, kept or maintained on the lands.

17.               No cattle, hogs, sheep, poultry or other livestock or animals, other than household pets normally permitted in private homes in residential areas, shall be kept on the Lot.

18.               The lands shall not be subdivided at any time without the express written approval of Tim Banks or his designate.

19.               Any amendments or other changes to these Covenants can be made by Tim Banks or his designate within the period ending June 30, 2011, in its sole and absolute discretion and, thereafter, by agreement of at least 70% of the subdivision property owners.

20.       The restrictions herein severable and the invalidity or unenforceability of       any restriction shall not affect the validity or enforceability of any other restrictions.
